Terms of Service
Effective Date: April 30, 2026
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Submit Bonds, LLC, doing business as Submit Bonds ("Submit Bonds," "we," "our," or "us"), a Florida limited liability company operating under the ownership of its South Carolina parent entity. Submit Bonds operates the website located at www.submitbonds.com and any related domains, applications, software, and services (collectively, the "Platform").
By accessing or using the Platform — including by checking any acceptance box, signing up as an agent, or otherwise transmitting data through the system — you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accessing the Platform in the course of your employment or representing an organization, you also bind your employer or organization to these Terms.
If you do not agree to these Terms, do not access or use the Platform.
2. Platform Purpose & Scope
The Platform provides a secure system for the submission, review, and management of bail bond information among licensed bail bond agents, detention facilities, surety carriers, and authorized government personnel. The Platform facilitates workflow and data exchange; it does not act as a surety, issue bonds, or render legal determinations.
3. Authorized Use & User Eligibility
Access to the Platform is restricted to:
- Licensed bail bond agents in good standing with their applicable state regulator
- Detention facility (jail / corrections) personnel acting in an official capacity
- Surety carriers and their authorized representatives
- Authorized administrators designated by Submit Bonds
- Other government or regulatory personnel expressly authorized in writing
By accessing the Platform, you represent and warrant that you fall within one of the categories above and that you are authorized to act on behalf of any entity you represent. You further agree that you will:
- Access only the data, records, and functions relevant to your authorized role
- Maintain the confidentiality of your login credentials and not share them with any third party
- Not attempt to access data or system functions outside the scope of your authorization
- Promptly notify Submit Bonds of any actual or suspected unauthorized access or breach
Unauthorized use may result in immediate suspension or termination of access, reporting to applicable regulatory authorities, and pursuit of all available legal remedies.
4. Intellectual Property & Anti-Replication
Submit Bonds claims ownership of all intellectual property associated with the Platform, including but not limited to its screen designs, layouts, user interface elements, workflow logic, integration patterns with third-party services, source code, documentation, and the manner in which features are presented to clients. All such elements are proprietary to Submit Bonds and protected by copyright (registered or unregistered), trademark, trade secret, and other applicable intellectual property laws.
You shall not, and shall not permit any third party to, directly or indirectly:
- Copy, reproduce, screenshot, scrape, or extract any portion of the Platform's content, design, or data, except as expressly required for your authorized use
- Reverse engineer, decompile, or disassemble any portion of the Platform
- Replicate or attempt to replicate the products, features, workflows, or business model of the Platform
- Use access to the Platform — whether direct or through a client relationship — to derive knowledge of Submit Bonds' commercial offerings for the purpose of creating a competing product or service
- Provide access, screenshots, exports, or descriptions of the Platform's protected elements to any third party for any of the purposes described above
These restrictions apply whether the prohibited activity is conducted for the User's own internal use or for the benefit of any third party. Any breach of this Section 4, in the reasonable opinion of Submit Bonds, will be deemed to cause harm or potential harm to the business of Submit Bonds and will constitute a material breach of these Terms.
5. Data Sources, Accuracy & User Responsibility
The Platform integrates data from multiple sources, including:
- Florida Department of Financial Services (DFS) license records
- Equivalent state regulatory records in jurisdictions where the Platform operates
- User-submitted data from agents, detention facilities, and carriers
- Third-party identity verification, document, and compliance providers
Submit Bonds does not guarantee the real-time accuracy, completeness, or availability of any external dataset. Users remain solely responsible for:
- Verifying the current license status and authority of any party with whom they transact
- Confirming legal eligibility to issue, post, or accept any bond
- Ensuring that all information submitted through the Platform is accurate, current, and complete
6. Submission & Review Workflow
The Platform facilitates the submission of bail bond paperwork, review by authorized detention facility personnel, and status tracking through stages including but not limited to Pending, Approved, Rejected, and On Hold.
Submit Bonds does not make legal determinations, does not issue bonds, and does not act as a surety. All decisions regarding acceptance, rejection, or processing of any submission are made solely by authorized detention facility officials, licensed sureties, or other authorized entities. Submit Bonds is not a party to any bond transaction and assumes no liability for any decision made by an authorized reviewer or for the legal consequences of any bond.
7. Submission Standards
To be accepted by receiving facilities, all bond submissions must comply with current Submit Bonds Submission Standards, which include:
- All Power of Attorney and General Appearance bond scans must be legible, in full color, and free of correction fluid or visible alterations.
- Power of Attorney and General Appearance bond forms may be typed, but both must be hand-signed by the User.
- The complete Power of Attorney number must be entered into the Power Number field and must match the original paper Power of Attorney.
- Charges and bond amounts must match the receiving facility's records.
- The defendant's name must appear consistently and accurately across all submitted documents. Corrections that change the identity of the named defendant are not permitted; corrections that complete or clarify the same defendant's name are permitted.
- Every submitted document must bear a notation indicating it was submitted through Submit Bonds (e.g., "Submitted through www.submitbonds.com").
- All original Power of Attorney paper forms must be mailed to the issuing surety within thirty (30) days of electronic submission, with a tracking number provided to Submit Bonds. Failure to comply with this requirement may result in restriction or revocation of Platform access until compliance is restored.
Submit Bonds may update these standards from time to time. Current standards are available within the Platform and supersede any prior version.
8. Identity Verification & Document Handling
In the course of using the Platform, Users may be required to submit government-issued identification, biometric data such as selfie images, license documentation, and other supporting materials. By submitting any such information, you represent and warrant that:
- You have the legal right to provide the information
- The information is accurate, current, and not fraudulent
- You have obtained any consents required from third parties whose information you submit
Submit Bonds reserves the right to flag suspicious submissions, retain audit logs of identity verification activity, decline to process any submission, and share data with regulatory or law enforcement agencies as required or permitted by law.
9. Audit Logging & Monitoring
All activity on the Platform is logged, including logins, submissions, status changes, document access, and administrative actions. These logs may be used for internal compliance, fraud prevention, regulatory reporting, response to legal process, and investigation of suspected misuse. Users have no expectation of privacy in their use of the Platform beyond what is set forth in our Privacy Policy.
10. Confidentiality
In the course of using the Platform, you may receive or have access to non-public, proprietary, or confidential information of Submit Bonds, its clients, sureties, agents, or detention facilities ("Confidential Information"). Confidential Information includes, without limitation, technical and non-technical data; software and source code; database structures; pricing and financial information; customer, vendor, and supplier lists; marketing and operational plans; methods, processes, and know-how; and any information marked as confidential or that a reasonable person would understand to be confidential.
Confidential Information does not include information that: (i) was lawfully known to you before disclosure, free of any obligation of confidentiality; (ii) becomes publicly available through no fault of yours; (iii) is rightfully received from a third party not under a confidentiality obligation; or (iv) is independently developed by you without reference to the Confidential Information.
You agree to:
- Use Confidential Information solely for the purposes authorized under these Terms
- Hold Confidential Information in strict confidence using at least the same degree of care you use to protect your own confidential information, and in no event less than reasonable care
- Limit disclosure to your representatives who have a need to know and who are bound by confidentiality obligations no less protective than those in these Terms
- Not disclose Confidential Information to any third party without prior written consent of Submit Bonds
Confidentiality obligations under these Terms survive termination and remain in effect for so long as the Confidential Information retains its confidential character.
11. Privacy
Use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, store, and disclose personal information. Submit Bonds does not sell or rent personal information collected through the Platform. Personal information may be disclosed only as permitted by the Privacy Policy or as required by law.
12. Prohibited Conduct
In addition to any other restrictions in these Terms, you may not:
- Submit false, misleading, or fraudulent information
- Impersonate any person or misrepresent your authority or affiliation
- Attempt to bypass identity verification, authentication, or access control mechanisms
- Scrape, export, or harvest data from the Platform without express written authorization
- Interfere with, disrupt, or attempt to compromise the security or integrity of the Platform
- Use the Platform in any manner that violates applicable law or any third-party rights
- Hack, gain unauthorized access to, or impersonate another User or person
13. Suspension & Termination
Submit Bonds may suspend or terminate your access to the Platform, in whole or in part, with or without notice, if:
- You breach these Terms or any other agreement with Submit Bonds
- Suspicious or fraudulent activity is detected on your account
- Required by law, regulation, or order of a regulatory or judicial authority
- Your underlying license, appointment, or authority to act in your stated capacity lapses or is revoked
Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination — including Sections 4 (Intellectual Property), 10 (Confidentiality), 14–18, and 20–23 — will survive.
14. Injunctive Relief
You acknowledge that a breach of Sections 4 (Intellectual Property), 10 (Confidentiality), or 12 (Prohibited Conduct) of these Terms would cause Submit Bonds irreparable harm for which monetary damages would be inadequate. Accordingly, in addition to any other remedies available at law or in equity, Submit Bonds is entitled to seek injunctive relief and specific performance to enforce these provisions, without the need to post bond or prove actual damages.
15. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. SUBMIT BONDS DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND UNINTERRUPTED OR ERROR-FREE OPERATION. SUBMIT BONDS DOES NOT WARRANT THAT ANY DEFECTS WILL BE CORRECTED OR THAT THE PLATFORM WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUBMIT BONDS SHALL NOT BE LIABLE FOR:
- Any legal outcomes, decisions, or consequences related to any bond transaction, including approval, rejection, forfeiture, or revocation of any bond
- Errors, omissions, or unavailability in any third-party data source, including state DFS or equivalent regulatory records
- Inaccuracies in User-submitted information
- Any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data, even if advised of the possibility of such damages
In no event shall Submit Bonds' aggregate liability arising out of or related to these Terms exceed the greater of (a) the total fees paid by you to Submit Bonds in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).
17. Indemnification
You agree to indemnify, defend, and hold harmless Submit Bonds, its parent, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of the Platform; (ii) your breach of these Terms; (iii) your violation of any law or third-party right; or (iv) any content, data, or information you submit through the Platform.
18. Governing Law & Venue
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles. The state and federal courts located in Florida shall have exclusive jurisdiction and venue over any dispute arising out of or relating to these Terms or the Platform, and you irrevocably consent to such jurisdiction and venue. To the extent any portion of the Platform's operation involves the laws of another jurisdiction in which Submit Bonds maintains an active county or state profile, the laws of that jurisdiction may also apply to disputes arising specifically from operations within that jurisdiction.
19. Attorneys' Fees
In any legal proceeding brought to enforce these Terms or arising out of an alleged breach or dispute, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs in addition to any other relief awarded.
20. Modifications to These Terms
Submit Bonds may modify these Terms at any time by posting an updated version within the Platform or on the Submit Bonds website. Material changes will be communicated through the Platform, by email, or by other reasonable means. Your continued use of the Platform after the effective date of any modification constitutes acceptance of the updated Terms.
21. Entire Agreement
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference or executed between you and Submit Bonds, constitute the entire agreement between the parties regarding the Platform and supersede all prior or contemporaneous agreements, understandings, or representations, whether written or oral.
22. Severability & Waiver
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, severed from these Terms, and the remaining provisions will continue in full force and effect. The failure of Submit Bonds to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
23. Assignment
You may not assign or transfer these Terms or any of your rights or obligations hereunder without the prior written consent of Submit Bonds. Submit Bonds may freely assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law. These Terms bind and benefit the parties and their permitted successors and assigns.
24. Notices
Notices to Submit Bonds must be sent in writing by email or certified mail to the contact address designated within the Platform or at the registered address of Submit Bonds, LLC. Notices to you may be sent to the email or physical address associated with your account or by posting within the Platform.
25. Headings & Interpretation
Section headings are for convenience only and do not affect the interpretation of these Terms. These Terms shall be construed according to their plain meaning and not strictly for or against either party based on authorship.
